Hiring High Skilled workers - Supporting their PR

 

 

If Employer is Making a Job Offer under IRCC Express Entry System. You can do that in following categories

 

Provide Employer complies with the following Requirements:

 

1.    Employer is not Embassy

2.    Employer is not high commission or consulate in Canada

3.    Ineligible employers

4.    New and have not been in business for minimum of one year

5.    Hiring workers who intend to reside in Quebec.

 

 

a.    FSWP (Federal Skilled Workers Program)

 

(i)            Job offer should be Management, professional, scientific, technical or trade occupations (NOC skill type O, A and B.

(ii)           Full time hours (Min. 30 hours per week)

(iii)         At least one year

(iv)         Non seasonal position.

 

 

b.   FSTP (Federal Skilled Trades Program)

 

(I)            Eligible skilled trade or technical position (Noc Skill Level B)

·       Major Group 72, industrial, electrical and construction trades

·       Major Group 73, maintenance and equipment operation trades

·       Major Group 82, supervisors and technical jobs in natural resources, agriculture and related production

·       Major Group 92, processing, manufacturing and utilities supervisors and central control operators

·       Minor Group 632, chefs and cooks

·       Minor Group 633, butchers and bakers

 

(II)          Full time hours (Min. 30 hours per week)

(III)        At least one year

 

 

 

c.    CEC (Canadian Experience Class)

 

(i)            Job offer should be Management, professional, scientific, technical or trade occupations (NOC skill type O, A and B.

(ii)           Full time hours (Min. 30 hours per week)

(iii)         At least one year

(iv)         Non seasonal position.

 

 

Under the CEC, the foreign worker must have at least 12 months of full-time (or an equivalent amount in part-time) skilled work experience in Canada within the 36 months prior to applying for permanent residence

 

 

Employer who is hiring here, may also want to hire them, while their application is pending for PR. As a result, Employer may file Dual Intent LMIA, which requires paying processing fee. These dual Intent applications are filed, to support foreign national for PR and their work permit.

 

 

Program Requirements

 

1.    Hiring Foreign Care Giver to provide Home Care (Medical Needs Purpose) is exempt from paying LMIA fee.

2.    Families with Gross Annual Income of 150K or less, seeking to hire caregiver for child under 13 years of age is also exempt from paying LMIA fee.

3.    If you are supporting only for PR, then LMIA fee not applicable (POST PR no LMIA REQUIRED, AND PRIOR TO THAT YOU ARE ANYWAYS NOT HIRING-That’s the reason, But still LMIA is required)

4.    Hiring skilled positions related to on farm primary agriculture such as farm managers/supervisors and specialized livestock workers (NOC 0821, 0822, 8252 and 8255)

Language for Work

 

-         subsection 203 (1.01) of the Immigration and Refugee Protection Regulations (IRPR)

-         Only English and French can be shown as requirement for work, both in application and advertisement, unless employer demonstrated that another language is ESSENTIAL.

 

Positions with no language requirement

 

-         More details on how foreigner will perform job duties and safe manner without being able to communicate effectively.

-         Health and safety measures in place.

 

 

Education Components. Duty to verify is on Employer

 

-         Regulated Occupation.

-         Employers hiring foreign work in regulated occupations need to make arrangements with regulatory body for his/her certification.

-         Standard seen is that whether have you got yourself certified or will you be certified before issuance of work permit.

 

 

Lastly, IRCC for the purpose of PR

 

-         Must be satisfied that skilled worker are able to perform AND

-         Likely to accept and carry out the employment being offer to them.
